AAA New York State is an association whose membership includes all five New York AAA Clubs. The Association's principal mission is to act collectively on behalf of the Clubs to promote traffic safety and advocate for our 2.6 million AAA members  in the legislative,  administrative and public policy areas.

2007-2008 Legislative Session

A31/S2446 Directs the Department of Transportation to survey areas of the state with a high incidence of pedestrian accidents involving senior citizens and utilize the results to study methods to reduce dangers to pedestrians in the identified areas.

A44 Requires motor vehicle repair shop operators to inform customers of their right to inspect repaired vehicles and inspect and retain replacement parts.

A48 Codifies and expands the time period within which motorists may file repair shop complaints with the Department of Motor Vehicles.

A58/S637 Amends the penal law in relation to making it illegal for health care providers and attorneys to pay or offer to pay a pecuniary benefit to a "runner."

A102/S190 Provides that no license or learners permit shall be retained by a person under the age of 18 unless such person either : holds a high school diploma or equivalent diploma or; is enrolled in and attending an educational program and maintains a good attendance record.

A104/S174 Requires all occupants to wear safety belts when riding in the rear seat of a motor vehicle.

A194 Provides that fines received from drivers convicted of driving outside the terms of a conditional license be deposited in county established STOP-DWI programs.

A200 Dedicates revenue collected from fines imposed on motorists who illegally pass a stopped school bus to establish a school bus safety program.

A202/S1353 Authorizes operation of electric personal assistive mobility devices, "Segway Scooters™", subject to certain restrictions, on sidewalks and roadways.

A204/S480 Requires motor vehicle operators to exercise due caution when approaching a parked, stopped or standing hazard vehicle.  For operators of vehicles on controlled access highways, provides that such "due caution" shall include moving over to an adjacent highway lane.

A210/S1350 Includes tinted windows and license plate covers in the annual motor vehicle safety inspection.

A211 Requires that the unexpired portion of a passenger vehicle registration be refunded to the registrant upon surrender of the license plates and provides for a pro-rated refund when registration is transferred to a lighter vehicle.

A227 Prohibits operation of a pick-up truck while persons under the age of eighteen years are riding in the cargo area of such trucks.

A409/S561  Increases fines for operating a commercial vehicle on a parkway.

A420/S1546 Exempts child safety seats from sales tax.

A446/S885 Provides that any person selling or delivering more than five motor vehicles in one year via the internet be considered an automobile dealer as defined by law and, consequently, subject to certain guidelines set forth under the Vehicle and Traffic Law.

A495 Requires motor vehicle repair shops to post bond with the Department for Motor Vehicles to assure the collection of fines, penalties and restitution awards to motorists.

A516 Requires the Commissioner of the Department of Motor Vehicles to promulgate 

A1021 Requires public authorities to analyze the long-term consequences of privatizing critical transportation infrastructure.  

A1278/S668 Provides that the sale and installation or sale of a previously deployed air bag shall be a Class A misdemeanor.

A1713/S290 Authorizes the discretionary imposition of emergency costs against those convicted of driving while intoxicated or driving while alcohol impaired.

A1737 Authorizes the discretionary impositions of emergency response costs against those convicted of driving while intoxicated or driving while alcohol impaired.

A1835/S263  Increases penalties for criminal convictions of driving under the influence of drugs where a child, under the age of 17, is a passenger.

A1907 Establishes an Automobile Insurance Consumer Information Bureau to make auto insurance cost and quality of service information readily available to consumers.  

A1936 Directs the Department of Motor Vehicles (DMV) to refuse registration of a vehicle if the registrants license is suspended or revoked.

A2042 Adds a new article 396-pp to the General Business Law which, among other things, would require new and used car dealers to make specified written disclosures when entering into vehicle service contracts with consumers including  the legal name and address of the service contractor; the dealer's contract price; whether or nor the contractor price is a negotiable item between the dealer and consumer; and the service contractor's suggested retail selling price.  

A2101 Grants motorists an administrative remedy to recover towing fees and out of pocket expenses incurred in connection with the wrongful towing of a vehicle in New York City.  

A2102  Provides that an owner of a stolen motor vehicle may credit the unused portion of the registration fee to any subsequent fee for the registration of another vehicle owned by the registrant. 

A2468/S1552 Requires the property damage threshold for filing a motor vehicle accident report with the Department of Motor Vehicles.

A2631 Prohibits use of any device which affects the operation of a traffic control signal.

A2813/S1428 Allows certain defenses to parking violations despite the fact that a default judgment had been entered.

A2959 Allows municipalities to establish speed limits as low as 15 mph.

A2964 Authorizes the discretionary imposition of emergency response costs against those convicted of driving while intoxicated or driving while alcohol impaired.

A3185 Provides that it shall be a defense to a charge of a traffic infraction for running a red light if the police officer manipulated the light immediately prior to issuing a ticket.

A3207/S1486 Adds a new section to the Vehicle and Traffic Law. "Aggressive Driving". Defines aggressive driving as speeding while simultaneously committing two other moving violations.

A3489 Amends the New York City Administrative Code and the Vehicle and Traffic Law so as to prohibit the towing of vehicles to satisfy an outstanding judgment unless said judgment exceeds $1,000.

A3654 Enacts the "Crash Repair Disclosure Act." Requires insurance companies to disclose to policyholders whether or not "generic" replacement parts may be used in the repair of their vehicles.

A3998/S1703 Enhances penalties for unlicensed operation of a motor vehicle and increases the penalties for Aggravated Unlicensed Operation (AUO) of a motor vehicle.

A4006 Renders parking tickets unenforceable if a default judgment is not entered until after the time period for entering such a judgment has expired (approximately two and one-half years after the issuance of the ticket).

A4031 Exempts vehicles that meet the "clean vehicle standard" from sales tax.

A4065 Increases penalties for operating a vehicle without a license; increases the minimum and maximum fines for violations from current range of $75-$300 to new range of $200-$1000;  adds new second offense provisions (applicable if there has been a previous conviction within the preceding five years) providing for imprisonment of up to thirty days and minimum and maximum fines of $500-$2000.

A4129 Amends the New York City Administrative Code and the Vehicle and Traffic Law so as to prohibit the towing of vehicles to satisfy an outstanding judgment unless said judgment exceeds $500 and the vehicle cannot be impounded by booting where it is found.  Prohibits the towing of any occupied vehicle in order to satisfy an outstanding parking violation.

A4392/s2278 Expands the definition of an unauthorized use of a motor vehicle in the second degree.

A4496/S2189 Enacts the Omnibus Auto Theft Victim Protection Act to promote citizen involvement in deterring motor vehicle theft and apprehending those responsible by establishing a toll-free hotline to provide police with information needed to combat auto theft.  Restricts funds raised by the state surcharge on automobile insurance to anti-theft programs.

A4796  Establishes procedures in relation to the identification and re-examination of medically impaired drivers.

A4811 Amends the Vehicle and Traffic Law (VTL) to provide for enforcement of operating a motor vehicle with a suspended license in a parking lot.

A5148/S2185 Enables policyholders enrolled in the "Combat Auto Theft" (C.A.T.) program to receive automobile insurance premium reductions. 

A5167/S634  Prohibits the operation of a motor vehicle where a video monitor displaying pre-recorded video signals is within the view of the operator.

A5218 Provides that with respect to a license suspension order for failure to appear, a record containing the date and nature of an alleged Vehicle and Traffic Law violation and the address to which the order of suspension was mailed shall have the same effect as a copy of a suspension order for the purpose of proving that such order was mailed; authorizes the DMV Commissioner to deny a vehicle registrant's license is suspended or revoked.

A5488/S403 Provides that surcharges derived from drivers convicted of alcohol related offenses be deposited in county established STOP-DWI programs.

A5512/S1272 Requires insurance carriers to provide an appropriate insurance premium discount to vehicles retro-fitted with daytime running lights (DRL) and authorizes the Superintendent of the Insurance Department to establish standards for their installation.

A5817 Enacts the "Motor Vehicle Owner's Right to Repair Act" mandating automobile manufacturers release of vehicle repair information to vehicle owners.

A6497/S2184 Enacts a comprehensive program which ensures that the serious problem of motor vehicle theft in this state is more effectively addressed by the criminal justice system.

A6669/A4523 Authorizes the City of Buffalo to implement a "Red Light Camera" program.

A6973 Increases the scope of Vehicle and Traffic Law (VTL) section 511 (1)(a), aggravated unlicensed operation of a motor vehicle in the third degree, to include individuals who have never held a valid driver's license and who have been previously convicted of such offenses within the preceding 18 months.

A7091/S1348 Prohibits the use of any device which affects operation of a traffic control signal.

A7181/A4296 Authorizes Nassau County to implement a "Red Light Camera" program.

A7302/S619 Amends the Vehicle & Traffic Law (VTL) to provide for enforcement of operating a motor vehicle with a suspended license in a parking lot.

A9362/S6432 Establishes the New York City Traffic Congestion Mitigation Commission and requires the Commission to submit a traffic congestion mitigation plan.
